Gov. DeSantis Terminates Local Government Restrictions and Mandates Imposed Based on COVID-19 State of Emergency
Governor DeSantis signed two Executive Orders on May 3, 2021 terminating state agency and local government emergency orders, restrictions and mandates imposed due to COVID-19. Executive Order 21-101 invalidates “any emergency order issued by a political subdivision due to the COVID-19 emergency which restricts the rights or liberties of individuals or their businesses” as of July 1, 2021. Executive Order 21-102 immediately suspends “all local COVID-19 restrictions and mandates on individuals and businesses” and further eliminates and supersedes all emergency orders and ordinances imposing such restrictions and mandates.
It appears that these Executive Orders extend only to COVID-19 emergency orders and ordinances issues by state agencies and local governments which impose restrictions or mandates on personal and/or business “rights and liberties.” It does not appear that these Executive Orders invalidate or supersede COVID-19 emergency orders and/or ordinances issued by a state agency or local government which afford additional accommodations or privileges to individuals or businesses.
